Article: Split Circuit Court Decisions Pave Way for Supreme Court to Stop CPS Taking Children Without Due Process

Published on August 21, 2020
By David Knight

Bureaucrats have been ignoring due process and the rule of law for many years now, destroying our Constitution by pretending their “rules” are “civil”, not “criminal”, and therefore you are not entitled to due process or protections in the Bill of Rights.  They can take your property in the War on Drugs without a conviction or even charging you with a crime.  They call it “civil” asset forfeiture. It’s criminal theft by government without any due process.  You have to sue to get your property back — if you can afford to sue.

ST. PAUL, Minn. (KMSP) - Hundreds of people turned out at federal court in St. Paul Tuesday morning to push for an overhaul of Minnesota child protection laws.

Legal kidnapping': CPS took infant from mother for four months; judge rules 'disinformation' used

By: Dave Urbanski September 28, 2018 3 min read

Amanda Weber brought her 10-month-old son Zayvion to the emergency room at Children's Hospital in St. Paul, Minnesota, in May because he'd been constantly coughing and previously had been treated for sleep apnea, Minnesota Public Radio reported.

Zayvion was hospitalized overnight, but Weber departed for Little Falls with her son the next morning prior to a doctor performing a follow-up examination, the outlet said. KMSP-TV reported that Weber wanted to go home after a long wait for another doctor and signed that she was leaving against medical advice.

Mom Regains Custody of 10-Month-Old Son Who Was Taken By CPS Because She Left the Hospital Too Quickly

Judge: "There is nothing in the record which would lead this court to believe that the mother is unwilling to provide the appropriate care for the child."

By: Lenore Skenazy September 24, 2018

A Minnesota mom whose 10-month-old son was taken from her by child protective services because she didn't stick around the hospital for a second opinion on his cough finally regained custody—four months and six court dates later. The judge ruled that the nurse who claimed Amanda Weber's actions left her child, Zayvion, in "danger of dying," had engaged in "disinformation."

According to Fox 9

It all started in May when Weber brought Zayvion to Children's Hospital for a cough. Doctors determined Zayvion was fine and stable, and after a long wait for another doctor, Weber wanted to go home and signed that she was leaving against medical advice. The next day, Zayvion was immediately taken away by CPS for medical neglect.

Activists say return of Little Falls, Minn., boy shows overreach by child welfare officials

By: Randy Furst September 19, 2018 12:24 p.m.

The child protection system in Minnesota is unjust and harmful to children, an advocacy group argued Tuesday, and as evidence, pointed to the decision by a state judge last week to return a 1-year-old boy to his mother.

"I am mad at the system for failing me and my son," said Amanda Weber, who brought her recently returned son, Zayvion, to a news conference in St. Paul.

The legal victory is symbolic for a coalition of parents and advocates seeking to change the state's child protection system. The group has argued that Minnesota's laws criminalize parents for what they consider to be routine parental discipline and have a disproportionate effect on black families.

Little Falls mother fights for custody of son, joins in call for change in Minnesota law

By: Nora G. Hertel June 11, 2018

Amanda Weber

LITTLE FALLS — Amanda Weber took her 10-month-old to the hospital in May for a persistent cough. She lost custody of him a couple days later.

She has joined an association of parents who claim Minnesota's child protection laws are unconstitutional and overly vague.

The group, called Stop Child Protection Services from Legally Kidnapping, sued the state in April and filed an amended complaint last week.

In Weber's case, a hearing Monday at the Morrison County Courthouse ended with a judge scheduling another hearing later this week. She hopes to regain custody of her youngest child then.

A group of parents in Minnesota called Stop CPS From Legally Kidnapping Children has filed a request in federal court to “shut down the state’s child protection services, stop serial abuse of families and overturn the unconstitutional laws by which the agency operates,” according to a press release published Tuesday.

The group, led by Dwight Mitchell, a father who says his son was illegally taken from him for 22 months, first filed a civil rights complaint in April, and this week they vocally publicized their call to shut down the child services agency, which they claim engages in systemic lying, withholding information, and fabricating evidence.

Lawsuit Filed Against Minnesota Child Services.

By Hickory Mack

I am not personally a fan of spanking. In fact, I'm that annoying mom on Facebook posting Harvard Study articles on the effects of spanking on the neurological growth of children. I am 100% an advocate of personal growth, responsibility, and against ANY violence against children.

That being said, I do not believe that a parent spanking their child in a reasonable manner should be grounds for CPS taking children away from their families. Many feel they spank out of love, attempting to teach their children right from wrong through respecting and fearing authority.

St. Paul, MN – A parent’s rights organization filed a letter in federal court on Tuesday asking a federal judge strike down Minnesota’s current child protection laws for being too expansive and removing children from loving and safe homes without due process.

“Families are being abused, and in some cases, destroyed, as a result of laws that are inappropriate,” said Dwight Mitchell, the lead plaintiff in the case and founder of the parents’ association. “This is legal kidnapping.”

Minnesota Parents Seek A Statewide Ban On Child Removals

By Star Tribune (Minneapolis) | Jun 7, 2018

A group of Minnesota parents has asked a federal judge to strike down Minnesota’s child protection laws, saying they are overly broad and put children at risk of being removed from safe and loving homes.

In a letter filed in federal court Tuesday, the parents are seeking a court order declaring that certain state laws that govern when and how children can be removed from their homes are unconstitutional and deprive families of due process. The growing parents’ association, Stop Child Protection Services From Legally Kidnapping, said it has documented nearly 50 cases in 23 counties across the state in which children were wrongly removed and placed into foster care, based on false or disputed evidence.
